The War On Our Constitution And The Path To Victory

There are continuous attacks on our Constitution by Mr. Obama and many of our politicians through the Enviromental Protection Agency, Health & Human Services, the Education department, and the Transportation Security Agency. There are so many of these agencies that I don’t think the politicians themselves know them all. Also there is unconstitutional legislation like the healthcare law. Don’t take my word for it. Look at the enumerated powers listed in our Constitution and then compare that to what each of these agencies are currently doing to withhold our natural resources, force us to compromise our religious belief’s and our right to privacy, indoctrinate our students into socialist and marxists ideology through radical teaching, and take away our right to due process at all airports where we are treated as criminals until we prove our innocence.

But these attacks are most onerous within the healthcare law. This one law all by itself could totally change life in our country from freedom to slavery.  You think that can never happen in America. I thought so too until the healthcare bill was passed into law through bribery and coercion and against the consent of the people.

All of this may appear very complicated but if we look at it through the lens of our Constitution it  sorts itself out pretty quickly. Look at our Constitution and you will find that none of these agencies mentioned above and the actions they take appear in the enumerated powers of the executive branch as listed under Article II. There are many more such violations of the enumerated powers our Constitution grants each branch of government. Too many to go into here.

This war on our Constitution has been ramped up tremendously in the last several years but it’s been going on since before the great depression. Whenever legislation has passed that gives any branch of government a power that is not an enumerated power granted by our Constitution a battle has been lost along with a little of our individual rights. A presidential veto would be the right thing to do for any such legislation along with the page showing this is not an enumerated power. Alas, very few of our leaders have had the courage nor the fortitude to do this. An example of this is social security. There is no enumerated power for this in Article I, section 8 of our Constitution.

Each piece of legislation that is not held up to our Constitution to see if it is within the boundaries of the government’s enumerated powers actually changes the relationship between the government and the individual and this change is never good for the individual. Is it ever good to let someone else decide for you? Of course not. That would be like saying being robbed is good for a person. In actual fact when we are robbed of some of our liberty we also lose some of ourselves as well.

There is only one correct way to change our Constitution and it is not through legislation or executive order. It is through Article 5 of our Constitution. Read through it and you will find that this procedure if followed will give, ”We the People”, the most say in the proposed change. A change like that put forth by the healthcare bill would have never seen the light of day if our politicians upheld their oath of office and followed our Constitution.

So, what can we do about this seemingly disastorous predicament we find ourselves in? We can study our founding documents with friends and family. There are resources and suggested sites on this blog to help you.  Start or join groups who want to put our Constitution back in use. Contact your representatives, senators and the president insisting on the same. Last but not least keep dreaming of the day when the Declaration of Independence, the Constituion, and the Bill of Rights are known so well by all of us that no politician or bureaucrat will dare violate them!

Balance Of Power & Our Freedom

In our government today we have a congress that is giving to the executive branch more and more power over each and every individual American and in so doing it is creating an imbalance between the three equal branches of government. Of course this has been going on for decades but is much more noticeable now since the abuse by the executive branch has been so flagrant. Just take a look at the stimulus bill, the healthcare bill and the banking bill and the methods used to pass them. [There are links to these bills in an earlier article, "Liberty & Enforcing The Constitution".] A media, sometimes referred to as the “fourth branch of government’, also provides no checks to any branch of government since most of the media’s goals are the same goals as those running it, control over the people. The abuses by these groups are too numerous to mention here but if you just follow the political news and the money I believe you will come to the same conclusion.

Since the balance of power within our government is so skewed the real “fourth branch” must take charge. That is us the American people. In just a few days we will be able to “fire” every congressman and a portion of the senators who have voted to take freedom & liberty from all of us, our children and our grandchildren. To say this is a very important election is a supreme understatement.

I am going to do everything in my power to encourage people to get out and vote. I hope you will too. If all of us who believe in our Constitution vote, we will have a resounding victory, not only for ourselves, but for all Americans. And our country will continue to be the last best hope for Freedom & Liberty.

Liberty & Enforcing The Constitution

I don’t know about you but I believe that I am perfectly capable of taking care of myself, my family(and extended family) and our business, of helping our church, helping our community, and in so doing by extension helping our state and our country. I’m fairly certain that most of you feel this way too.

The idea that a politician via the government has the job of taking care of all Americans and all their problems besides being impossible is also utterly absurd since the government cannot even run the post office without being “way in the red”.

In going over the Constitution one will find that there is, “not a darn thing in there”, that gives the government that power. If someone thinks there is then we must first get their agreement to check out what the Constitution actually says and secondly we must make sure there are no misunderstanding of words and if so get the dictionary out to get the actual meaning. There is more than one definition for many words and confusion can result if we have an incorrect one. Many of you know this already but some do not.

The definitons for enforce are as follows; 1 obedience by threat and 2 to execute effectively. This is according to Merriam-Webster’s collegiate dictionary. Now, I’d prefer to use only definition 2 but since we have strayed so far from the Constitution I believe we have to use definition 1 as well. Helping individuals(even politicians) understand the Constitution is the goal. The Constitution is our reality, our agreement as far as our government is concerned. Without it there is no agreement. As Americans we know what the government can do and more importantly what it can’t do. All a person need do is look around at what our government is doing right this moment by passing laws that are: 1. Against the will of the people.  2. Nationalizing whole industries (the healthacare bill, banking bill, auto bailout). 3. So large, twisted and convoluted that the politicians themselves don’t know what’s in them. 4. Changing our Constitution bypassing Article V (which tells us how to change it giving the individual the utmost protection). These are serious matters and our individual rights as stated in the Declaration of Independence are going to vanish if this continues much longer. Some may say this could never happen. If you think this then I ask you to take another good look at it before you dismiss these assertions.

We must be totally unreasonable about this. That is why we must let politicians know they will be voted out of office if they refuse, by their actions not their words, to comply with reading and applying the Constitution. Being reasonable (accepting excuses, reasons etc.) has gotten us into the mess we are in at this moment in history (The Great Society etc.).  

So, let’s get back to our fundamentals and drag our politicians along with us. On second thought we should fire any politician that voted for the stimulus bill, the healthcare bill, the banking bill or the cap & trade bill (energy bill).

Enforce the Constitution and we will keep our Liberty.

Liberty & Missouri’s Healthcare Freedom Act

The Healthcare Freedom Act will come up for a vote on Tuesday, August 3rd 2010. It will be listed as Proposition C on the ballot. (A lawsuit claiming the Healthcare Freedom Act is unconstitutional was filed in late June by two Mo. voters. A judge says the  ruling will be quick.) Check your calendars and set aside enough time to vote yes for this statute securing our freedom to choose  in Missouri.

This statute is brief, to the point, and secures our right to choose our own health insurance plan if we want one. Some people prefer to pay for most services in cash and purchase a catastrophic plan with a high deductible. This saves money for those that take good care of their bodies but provides a cushion for a catastrophe. (Under the healthcare bill this will not be approved by the administration and you will be fined/taxed.) Others can participate in the federal plan if they wish or any private plan of their choice without penalty.  These are choices which any free society would secure for its people with no questions asked. Forty one other states have introduced similar legislation which basically protects the individual, employers and state governments from federal mandates on healthcare.

The federal government is trying through the congress and judicial activism to amend our constitution. This is not the procedure laid out in Article V of the constitution and should be stopped now. Repeal of the healthcare bill is essential to all Americans and especially to our children and grandchildren. Any congressman or senator who voted for the healthcare bill should be voted out of office. Remember November!

Keep communicating to everyone you know and don’t know about the Constitution and how it applies to legislation, executive orders and states rights. Theses ideas and principles are too important to allow someone to insist that they are too controversial to talk about. So, don’t let them.

The future of our country hangs in the balance on what we do right here, right now.

A Great Victory For Liberty & Freedom In Massachusetts

Scott Brown is a beacon of hope to millions of conservatives across our great country. After all of the townhall meetings, tea parties, letters, e-mails and visits to senators and representatives the unheard of  has occurred. Ted Kennedy’s senate seat was lost to a conservative. There is excitement and it’s almost tangible amongst the people that I know. Some of us had almost lost hope but not now. The tide has turned. A tsunami is building and the socialists/fascists are sitting there numbstruck instead of running for cover. Believe me a sleeping giant has been unleashed.

A hearfelt thanks to all of you that communicated your outrage over the unconstitutional healthcare bill to your senators and representatives. Your intention was received and you did have something to do with the outcome of the Massachusetts election. So pat yourself on the back and your friends as well but we must increase the pressure that we’ve applied to our elected officials until they decide to uphold the constitution, as their oath states, or leave office on their own or through a resounding defeat at the ballot box. You see, all of their minions can’t stand up to a free people.  And that we are, a free people and no slick politician will ever take that away from us.

Is the healthcare bill dead? Nancy Pelosi says she doesn’t have the votes to pass it in the house. I’m not so sure she’s telling the truth but I am sure we must constantly watch these supposed leaders of our legislature lest they pass something in the dead of night.

A good idea might be to acknowledge all those senators and representatives who did vote against the healthcare bill. When they do the right thing we should also let them know that as well. 

I am definitely grateful to our founders for leaving us the constitution. Without it I shudder to think where we would be today.

One Million Stand Up For Liberty & Freedom

Although there is no formal count I believe there were at least one million  Americans in Washington DC on the 12th of September. Thanks to all of them for showing the politicians that we are serious about our right to life, liberty and the pursuit of happiness.

The healthcare bill is an opportunity for the federal government to take control of how we care for our bodies and much more. The government deciding for every family and individual in this country what kind of care is the right one and making you pay for it whether you want that care or not is not freedom.

The American Center For Law & Justice has discovered more in the healthcare bill. Planned Parenthood will have a presence in most schools.  The health and human services secretary will be in charge of these clinics not the school boards. So, again the feds are taking more power that doesn’t belong to them under The constitution.

The American Center For Law & Justice has a petition to scrap the whole healthcare bill. Take a look at it and the information about the bill and sign the petition if you agree with it. These petitions do make a huge difference.

The constitution exists for us to read, use and apply. Take a look at it. Especially ammendments 9 & 10. Also Article 1, section 8 the powers of congress. Decide for yourself and make a comment to your congressman. Do the same for your senator. Demand that they apply the constitution to all of their legislation.

Freedom & Liberty vs. Fascism/Socialism

Our constitution guarantees the rights of the individual. What does fascism guarantee? It guarantees that the state will highly regulate industry and labor, and suppress all opposition. What does socialism guarantee? Well, it guarantees that all industries are controlled and/or managed by the government or associations of labor(unions). Just the fact that government is managing or controlling anything is laughable in itself since it is an abject failure at managing or controlling so many things today. Just look around at the tax code, medicare, medicaid, Fannie mae, Freddie mac, public schools, the post office, HUD,  and on and on.

You might think that there is no way that this could come about in our country. But I submit to you that we are already on our way to either fascism or socialism. The government owns at least one  auto company, controls banks through the banking bill, healthcare through the healthcare bill and is controlling pay for execs and workers through a pay czar and minimum wage laws. Soon they may control energy, through the cap & trade bill. Oh, and let’s not forget the Chief Diversity Officer to control freedom of speech over the airwaves.

What happens to the individual in all of this? The individual becomes the pawn of the government. Exactly the opposite of the intentions of the constitution. What happens to freedom & liberty? They are sqashed out of existence. The state eventually becomes a machine with no judgement. Applying all laws literally and with beaurocrats arbitrarily making new regulations(pseudo-laws) on a whim. 

The constitution  is the only protection the individual has against the state. We must know it like the back of our hands. Read through it and demand that our senators, representatives, and the president apply it to all their legislation and executive orders. And if they don’t call them out on it. Persuade them to uphold the oath they took with mountains of pressure until they can do nothing else or fire them this November.

Our families, businesses, churches and our country are depending on you and me to put the lid back on our government and back in the box of limited government that the Founding Fathers created; The constitution .

Freedom & Liberty In The Constitution

I’ve read Article 1 section 8 of the U.S. Constitution. Get online yourself or take your copy out and read it too. It’s pretty amazing. This is the section on the powers of congress and nowhere does it state that the federal government can dictate to an idividual American how they should take care of their bodies. This is even more amazing since President Obama, Nancy Pelosi and Harry Reid are stating that they do have this power. Maybe they are just trying to grab more power from the individual. Their actions seem to more than suggest this.

In spite of  overwhelming opposition by ordinary Americans, the president and congress appear to only listen to the unions and groups like Organizing for America, which are special interests. I thought special interests were long gone from Washington. I guess not.

But let’s get back to the constitution. Article 1, section 8 has only one spot where you might be able to make a very small case for the healthcare bill. In the first paragraph of section 8 congress has the power to provide for the general welfare of the United States. How could someone decide from this statement that the government then has the power to tell you, the individual, how you should take care of your physical being.? Well, let’s see.

Here’s the definiton of general in Webster’s New World dictionary: 1. of, for or from all, not local, special or specialized 2. of or for a whole kind etc.  3. widespread(general unrest) 4. most common, usual 5. not specific or precise 6. highest in rank(attorney general).

The healthcare bill sure wouldn’t fit in any of these definitions. The bill itself is way too specific to be included under congress’s powers. And the exact words are, “of the United States”, not of the individual.

Ah, but what if the bill just allowed small businesses across the country to band together to get health insurance as a large group. This would give each small business a much better rate and it wouldn’t violate Article 1, section 8 of the constitution. Why? Because it’s general and non- specific. Yes, but you say that welfare is also in that paragraph. What about that?

The definition of welfare is: 1 a condition of health, happiness, prosperity etc.; well-being 2 organized efforts of goverment agencies granting aid to the poor, the unemployed etc. 

Okay, we know that definition 2 was not around when the constitution was written so we’ll scratch that. That leaves definition 1. So, we have health, happiness, prosperity for all of us but in a general non-specific way. This still doesn’t allow for the massive healthcare bill. So, how could someone come up with this bill under Article 1? The only way to do this  would be  by changing the definition of one or both of these words or by purposely mis-understanding or just not understanding one or both of these words.

Read this section for yourself and make your own decision. But, please read it and get involved. Our freedom & liberty depends on it.

Is The Healthcare Bill Constitutional?

That is a great question. I have a video you should watch from the Glen Beck program on Fox news. It is very enlightening. According to Article 1, Section 8 of the United States Constitution, the powers of congress are limited. Get this section out for yourself and read it. Any words you don’t know look up in a dictionary. Congress does not have unlimited powers.

The Founding Fathers expected that the members of congress would take their oath seriously, to uphold the constitution and not pass unconstitutional legislation. If they did pass a bill that was unconstutuional then the president would, taking his oath seriously, veto the bill. If the president signed the bill the courts would then knock it down because it was unconstitional. These are the checks and balances that were created for us.

Today though our entire government is filled with politicians who have contempt for our constutution. With such contempt, by even our president, anything goes and the slick politicians and marketing executives know best. When our checks and balances fail it is up to us, the people, to rise up and apply mountains of pressure to our politicians. Don’t stop. Don’t give up. Keep talking to your representatives and senators. Be forceful and passionate but be polite. Talk to your friends and get them educated on the issues and the constitution. Our kids and grandkids are depending on you. Be an activist for our constitution.
